For Distance (Online & Mail Order) Selling:

Under the Consumer Contracts Regulations 2014, a customer is allowed to return an item if they simply change their mind. A customer has the right to cancel at any time from the moment they place their online order, and up to 14 days from the day they receive the goods. The customer then has a further 14 days from the date they notify the retailer of their cancellation to return the goods. -There are exemptions to online returns which include tailor made/personalised goods.

For Faulty Goods:

Under the Consumer Rights Act 2015, a customer has an early right to reject goods that are unsatisfactory quality, unfit for purpose or not as described, and get a full refund. This right is limited to 30 days from the date the customer took ownership of the goods. If an item is faulty and needs to be returned, the customer does not need to pay postage costs for the return of the faulty item. If a customer is asked to return an item that arrived damaged, not as described or faulty, the retailer should refund the total cost of the return.

Full Terms & Conditions

All quotations are made and all orders are accepted subject to the Terms of Business as detailed below. No other Terms or Conditions that may be specified on customer’s orders can be accepted unless previously agreed in writing. Acceptance of goods is to be regarded as full and unconditional acceptance of these terms by both parties.

Prices charged are those ruling at the date of despatch. Prices quoted are GBP and exclusive of Value Added Tax. Minimum order value £25.00 nett. Carriage paid within the U.K. mainland on orders over £250.00 nett value. See below for delivery charges.

Availability: If an item is not in stock you will always be advised with the option to cancel your order if you would rather not wait. Backordered items are not charged until they are shipped.

Descriptions. Every effort is made to ensure that the goods in our catalogues, price lists, website and instruction leaflets are accurately described and believed to be fit for the purpose as described when used in a proper and correct manner. No responsibility can be accepted in the event of any error or mis-description in any literature or for any damage that may either directly or indirectly arise. Customers should ensure that goods are suitable for their specific intended purpose. All measurements (including metric / imperial conversions) are approximate and given for guidance purposes only.

Title to Goods shall remain with F.F.Franklin & Co Ltd. (the Seller) until either: (a) all amounts outstanding to the Seller from the Customer (for all contracts) are paid in full, or (b) the Customer sells the goods in the ordinary course of business, whichever occurs first.

For these purposes sales of goods by any Receiver, Liquidator, Trustee in Bankruptcy, or any other party acting in a similar or related capacity, shall not be deemed to be made in the ordinary course of business.

Passing of Risk. The full risk for any loss or damage to goods supplied shall pass upon delivery to the customer or when collected by the customer or customer’s agent.

Delivery Charges – (UK Mainland – excluding Highlands & Islands): Please refer to your carriage paid terms. Orders below this value will be charged at £10 + VAT and dispatched via a standard two day service. Urgently required items are charged at £12 + VAT up to 20 kilos and can be dispatched on a Next Day service subject to stock availability and ordered before 14.00 hours. A guaranteed next day service before 10.30 am and 12 noon are also available – please contact us for more information.

Claims for Loss or Damage in Transit. No liability will be accepted for damages or shortages in delivery unless the Carrier’s delivery sheet is endorsed ‘cartons received damaged /open/missing’. Written notice of any such endorsement must also be advised to ourselves and the Carrier on the day of delivery. Non delivery must be advised in writing within fourteen days of the invoice date.

Terms of Payment. Approved accounts are to be paid strictly nett within 30 days from date of invoice unless agreed otherwise in writing. Franklin Tools reserves the right to refuse to accept any orders against a credit account. The Seller reserves the right to add a surcharge to any overdue account of 1.5 % per month (or part thereof) above Barclays Bank base rate calculated from the original invoice date. If payment of any invoice is not made by the due date then the Seller (or their duly appointed agent) shall have the right at any reasonable time, and without prior notice, to enter upon any premises occupied by the customer and retake possession of all goods not paid for. This without prejudice to any other rights or remedies. The Customer shall be deemed for the purposes of identification to use all goods supplied on a first in and first out basis. The Seller reserves the right to refuse to accept any orders against a credit account.

We accept Visa and Mastercard credit and debit cards and BACS payments. Please contact us for our BACS details.

Cancellations: Orders cannot be cancelled once dispatched.

Cancellation of special orders for non-stock items or goods made especially to customer’s requirements cannot be accepted under any circumstances.

Delivery Dates given are to be regarded as best estimates only. No liability can be accepted for any loss, direct or indirect or consequential, arising from any delay.

Return of Goods. Goods supplied in accordance with customer orders will only be credited if returned carriage paid and in a saleable condition within 14 days. Credit will be based on the original invoice value, less an allowance for any missing parts, less a minimum handling charge of 10%. Credit will not be allowed against any unauthorised returns or for any obsolete or discontinued goods.

Warranty. All goods are warranted to do the work for which they are designed and intended. If any goods are shown to our reasonable satisfaction to be defective, by reason of faulty materials or workmanship, whilst being used for their proper purpose they will be replaced or repaired free of charge if returned carriage paid within twelve months of date of purchase. A copy of the end user sales receipt must also be enclosed for each item with full details of the specific reason for return. Goods showing evidence of abuse, mis-use, worn out, altered or used for purposes other than intended will if possible be repaired at cost. Stockists are not authorised to replace goods from stock. No liability is accepted for any claims for materials or consequential losses.

WEEE Compliance. The B2B end user is responsible for all liabilities regarding the environmentally sound disposal of this EEE when it is discarded as WEEE. The producer may, for commercial reasons only, offer a take back option when a B2B end user is purchasing a new product, however, this will be decided on a case by case basis and may incur a charge.

Tool Hire. Any tool that has been hired for reward is not covered by the above warranty. The responsibility for the condition and performance of such tools rests principally with the hirer who should take appropriate steps to ensure that hired tools remain suitable for their intended purpose at the commencement of each hire period.

Specifications. We reserve the right to amend designs or specifications, or discontinue lines without prior notice.

Copyright. All drawings, catalogues, price lists, guidance instructions, other documents and computer data are supplied on the strict understanding that full copyright remains with F.F.Franklin & Co Ltd at all times. The copying or exhibiting of such material can only be permitted if specifically authorised in writing.

Display Stands are supplied, on loan, for the sole purpose of displaying Franklin Tools. Title to stands remains with F.F.Franklin & Co Ltd at all times. We reserve the right at any reasonable time, and without prior notice, to enter upon any premises occupied by the customer and re-possess any such merchandisers subject to : (a) any mis-use of display stands, (b) any default in payment for goods supplied, or (c) any insolvency proceedings or termination of business.

Law and Jurisdiction. Any disputes arising from any of the above conditions shall be governed and interpreted exclusively according to English Law and be subject to the jurisdiction of English Courts only. Headings are shown for convenience only. If any of these conditions (or any part thereof) are held to be invalid the validity of the other conditions (or parts thereof) shall not be thereby affected. The Seller reserves the right to amend the Terms of Business and Conditions of Sale upon giving 30 days written notice of any such variation to the Customer.

Safety Guidelines

1. Before commencing a task always ensure that you have access to appropriate working conditions / tools / equipment and that you fully understand what needs to be done. For detailed step by step instructions refer to the workshop manual for the specific equipment that is to be serviced.

2. Confirm that the tools that you intend to use are in a good serviceable condition, the correct size, and are designed to safely withstand the loads that are likely to be applied. Ensure that any forcing screw threads or moving parts are clean and well lubricated. ONLY USE TOOLS AS INTENDED FOR THEIR DESIGNED PURPOSE. Any tools that do not fully comply with the above, or have been modified, or have signs of any defects or excessive wear are potentially unsafe and should be immediately replaced.

3. ALWAYS WEAR APPROPRIATE APPROVED PROTECTIVE SAFETY EQUIPMENT (goggles, ear defenders, gloves, helmet, boots clothing etc) to properly protect all personnel from all potential hazards where tools and equipment are in use. PLEASE REFER TO www.hse.gov.uk FOR FURTHER TOOL SAFETY INFORMATION

4. Adopt a safe and firm working position to prevent a fall or other accident should the tool or the work piece slip. Use a heavy cloth or shield to guard against seized or tight fitting parts that may suddenly fly off, without warning, when released.

5. Ensure that tools are correctly mounted. Do not over-tighten or use undue force as this can cause damage to both the tool and the component - which may in turn result in personal injury.

6. Use penetrating oil on seized parts, stubborn nuts or tapers to ease removal.

7. DO NOT USE SUDDEN OR EXCESSIVE FORCE. Apply force gradually. If a part cannot be released as expected check that the correct procedures have been followed and consider if additional equipment or third party assistance is required to complete the task safely.

8. When working under a vehicle always ensure that it is adequately supported by axle stands or ramps. Check the wheels and ensure that the hand brake is firmly applied. .
